In the case of Italian consumers, the Italian legislation applies and as far as the jurisdiction according to the provisions of law Article 12 D.Lgs 50 of 1992 and Article 14 D.Lgs 185 of 1999 is always the jurisdiction of the judge of the place of residence or domicile of the consumer, any other provision is considered to be an unfair and non-applicable clause. In case of foreign consumers, the choice of which legislation to apply (Italian or that of the consumer’s country) is left to the parties, with due regard for the principle that minimum guarantees may not be waived and in any case the one most favorable to the consumer applies.
